Terms of Service

1. The parties
These Terms of Service ("Terms") are a binding agreement between you and Alrightly ("we," "us," "our"), the operator of Alrightly (the "Service"). Reach us via our contact form.
2. Acceptance
By creating an account or using the Service you agree to these Terms and our Privacy Notice. If you do not agree, do not use the Service. You must be at least 18 years old, or the age of majority in your jurisdiction, and have the authority to enter into these Terms.
3. The Service
Alrightly sends you scheduled check-in messages by email or push notification (Plus plan). SMS delivery is coming soon. If you do not confirm a check-in within your grace period, we notify the trusted contacts you selected. The Service is a convenience tool and is not an emergency-response service, medical device, fall detector, or substitute for professional or emergency care.
SMS Messaging Program (coming soon): Alrightly Plus offers optional SMS notifications to help users stay connected with their trusted contacts. If you choose to receive SMS messages, you may receive:
- Daily check-in reminders
- Reminder follow-up messages if you have not checked in
- Missed check-in alerts for users for whom you are a trusted contact
4. Your account
You must provide accurate information, keep your credentials confidential, and are responsible for activity under your account. Notify us immediately of any unauthorized use.
5. Acceptable use / prohibited conduct
You agree not to:
- Use the Service unlawfully or for fraud, harassment, or spam.
- Infringe intellectual property, privacy, or publicity rights.
- Attempt to probe, scan, or breach security; upload malware; or interfere with the Service.
- Scrape, reverse engineer, resell, or redistribute the Service.
- Invite trusted contacts without their consent, or use the Service to monitor anyone without a lawful basis.
- Rely on the Service as an emergency, medical, or life-safety system.
6. Intellectual property
The Service, its software, branding, and content are owned by Alrightly and our licensors. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service within your selected plan. All rights not expressly granted are reserved.
7. Payment and subscription terms
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing frequency, applicable taxes, renewals, and cancellations are governed by Paddle's Buyer Terms in addition to these Terms.
Subscriptions renew automatically for the term you selected (monthly or annual) until cancelled. You can cancel at any time; access continues through the end of the current paid period.

9. Service availability
We work to keep the Service running reliably, but we do not guarantee uninterrupted or error-free performance. Email delivery, push notification delivery, and SMS delivery once available, depends on third-party carriers and providers and can be delayed or blocked outside our control.
10. Suspension and termination
We may suspend or terminate your access, with or without notice, if you materially breach these Terms, fail to pay, create a security or fraud risk, or repeatedly violate our policies. You may stop using the Service and delete your account at any time in Settings. On termination, your license ends and we delete or anonymize your data as described in the Privacy Notice.
11. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the fullest extent permitted by law, Alrightly will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
13. Indemnity
You agree to indemnify and hold harmless Alrightly from claims arising out of your content, your use of the Service, or your violation of these Terms.
14. Governing law
These Terms are governed by the laws of the State of Vermont, USA, without regard to conflict-of-laws principles. The state and federal courts located in Vermont have exclusive jurisdiction, except where mandatory local consumer law provides otherwise.
15. Changes
We may update these Terms from time to time. Material changes will be communicated by email or in-app notice, and take effect when posted.
